North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that the employees were exposed to being struck by unsecured sections of precast concrete sewer manhole: a)job site at 254 Conrad Circle in Thomasville-on or about October 11, 2004, an employee transported unsecured sections of precast concrete sewer manholes up to 129 feet on forks attached to a CAT integrated tool carrier, a section of precast concrete sewer manhole was unsecured during transit and slid off the forks and rolled into an excavation striking an employee. "AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THIS HAZARD IS TO SECURE THE LOAD WITH CHAINS." ALSO FOLLOW DIRECTIONS IN THE MANUAL FOR THE CAT INTEGRATED TOOL CARRIER THAT INDICATES TO TRAVEL WITH THE LOAD UPHILL ON UPGRADES AND DOWNGRADES.
