Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were likely to cause death or serious physical harm to employees in that: employees were exsposed to struck-by hazards. a. Underground Utilities Inc.: At or about the Cold Creek subdivision in Sandusky, Ohio, on or about 6/9/04, employees were exposed to struck-by hazards in that starting procedures in the operator's manual for the John Deere 770 BH grader, serial number DW770BH512213, equipment number 802, were not followed. Employees were starting the grader by standing on the ground with no operator at the controls and by-passing the normal starting circuitry at the starter relay. Feasible means of abatement include, but are not limited to, following the starting procedures in the operator's manual or taking the grader out of service until replacing the starter relay. No abatement certification or documentation is required for this item.
