North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall from an unapproved site-built wooden platform: a)site, new church addition - the employer had provided an unapproved site-built wooden platform constructed by mating 2 wooden pallets and installing a 2"X4" wooden frame on three sides with no mid-rail for a completed measurement of 8 feet, 4 inches wide and 41 inches tall leaving an open front with no toe board. Among other methods, one feasible and acceptable abatement method to correct this hazard is to use appropriately designed personnel lifting equipment such as scissors-lift type vehicles or bucket trucks. Reference: ASME B56.6-1992, Paragraph 5.15.1(a): "Provide a personnel platform which complies with the design requirements listed in Part III of this Standard" b)site, new church addition - where the unapproved site-built wooden platform was tied to the backrest of a GRADALL Material Handler, Model 524D-3S, S/N 0277561, extendible-boom forklift with a length of nylon strapping. The manually adjusted forks of the forklift inserted into the normal pallet fork positions do not prevent side-to-side (rotational) movement. Among other methods, one feasible and acceptable abatement method to correct this hazard is to use appropriately designed personnel lifting equipment such as scissors-lift type vehicles or bucket trucks.
