Pepsi Bottling Group was previously cited for a violation of Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the risk of rollover of a fork truck without the use of seat belts, which was contained in OSHA inspection number 300467131, citation number 1, item number 2, issued on 2/12/2002 with respect to a workplace located at 1531 Monroe Avenue, Huntington, West Virginia. Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing or struck-by hazards due to lack of use of seat belts when operating powered industrial lift trucks: a.On or about June 24, 2003, in the raw materials area of production, the operator of an LP forklift did not wear the installed seatbelt to restrain and protect the operator from the hazard of being thrown from the lift or from crushing injuries in the case of a tipover of the forklift. b.On or about June 25, 2003, in the raw materials area of production, the operator of an LP forklift did not wear the installed seatbelt to restrain and protect the operator from the hazard of being thrown from the lift or from crushing injuries in the case of a tipover of the forklift. Among other methods, one feasible and acceptable method to correct this hazard is to enforce the use of seatbelts while operating forklifts. ABATEMENT CERTIFICATION IS NOT REQUIRED.TION
