40.1-51.1(a) of the Code of Virginia: The employer , All Your Maintenance, Inc., did not furnish a place of employment which is free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that: an employee was operating a JLG Boom Lift, Model 800A, S/N 0300051242, on a slope or incline greater than that recommended by the manufacturer of the lift. (a) On September 20, 2000, between buildings 1 and 2 at High Ridge Court, Blue Ridge Dr. & Wintergreen, Nellysford, VA., the employers on site supervisor was operating the lift on a slope of 10$ to 12$. A tilt alarm activated while the unit was positioned on the slope. (Alarm will activate when the slope is 5$ or greater). When the boom was at approximately. 32' above the ground, the lift tipped over throwing the victim out and to the ground. (Fall protection was not provided while in the lift.) The lift came to rest on its side with the boom resting on the balconies of building 2. The supervisor suffered fractures to the ribs, right leg and vertebrae and punctured lungs. One feasible and acceptable abatement method to correct this hazard (among others) is to operate the lift on a level surface (0$) such as that called for by the JLG Operators & Safety Manual (P/N 3120739, updated 1/99). TIP-OVER HAZARD warnings are posted on the equipment at the operator's control panel. The tilt alarm light indicator is on the control panel. The audible tilt alarm had been taped over.
