Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to engulfment hazards: a) #2 Bin - The employer failed to immediately take action to prevent total engulfment of an employee in a cold bin when notified that an employee was trapped on 4/24/00. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THIS HAZARD IS: Employer must develop and implement procedures for summoning rescue and emergency services and for rescuing entrants from confined spaces and must IMMEDIATELY initiate the procedures when an entrant needs assistance to escape confined space hazards.
