KRS 338.031(1)(a): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that: a.The paint mixer and his assistant used an uncertified lifting device which appeared to have been made in-house looped over one prong of a forklift to lift a 55 gallon drum of MC70 approximately 12-15 feet into the air to add to the mixing vat when preparing #73 paint. The lifting device had not been certified to verify construction and workmanship, ensuring that the device was capable of safely performing the task for which it was being used.
