Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of being crushed by falling loads: a.Shop - Employees were exposed to the hazards of being crushed/struck by falling loads due to failure of the custom-made lifting devices. The devices included lifting lugs on the waste steel skips, steel drums with holes cut in them to handle waste metals, lifting "tongs" found in the Parts Dept., the spreader beam used in the Short Bay #2, lifting lugs on the Squeezer and the lifting lugs on the welders. The capacities of the devices were unknown, there were no markings and they had not been load tested. (Specific abatement documentation is required. The cited equipment must be tagged in accordance with 29 CFR 1903.19(i).)
