Text For Citation: 02 Item/Group: 001 Hazard:
29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502. The employer failed to ensure employees were protected from falls and provided fall protection equipment when roofing a residential property. Employees performing residential roofing activities are not provided or required to utilize fall protection systems when exposed to falls. a) On or about February 5, 2026, the employer failed to provide employees engaged in residential construction activities with fall protection when exposed to unprotected sides and edges of a residential roof, thereby exposing employees to a 11.7 foot fall. b) On or about February 11, 2026, the employer failed to provide employees engaged in residential construction activities with fall protection when exposed to unprotected sides and edges of a residential roof, thereby exposing employees to a 11.7 foot fall. To abate this hazard in the future, the employer must ensure that its employees performing residential construction activities at six feet or greater are protected from falls, and that no employee is working without adequate fall protection. Abatement documentation is required of this item in accordance with the requirements of 29 CFR 1903.19(d).
