29 CFR 1926.651(k)(2): Where the competent person found evidence of a situation that could have resulted in possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employees were not removed from the hazardous area until the necessary precautions were taken to ensure their safety: a) Intersection of Norwood Lane and Chief Lane, Millsboro, DE 19966: On or about 08/14/2025, employees were exposed to crushed-by/caught-in hazards when the competent person did not remove employees from an excavation when they worked in the excavation with class-C soil continually sloughing during the inspection. No protective system was in place to mitigate the hazards the employees were exposed to. George & Lynch was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.651(k)(2), which was contained in OSHA inspection number 1529326, citation number 1, item number 3 and was affirmed as a final order on January 19, 2022, with respect to a workplace located at North of the intersection of Piping Plover Drive and Widgeon Path, Millsboro, DE 19966.
