Section 5(a)(1) of the Occupational Safety and Health Act of 1970: Upon Receipt The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a) On and before July 13, 1989 at the P.N.L Nursery yard and various landscaping sites. Employee(s) were exposed to the hazards of being caught in a scissor point of the bucket arms, of a new Holland Skid Steer Loader, when they were permitted to operate the loader with expanded metal side screen guard removed. Particular concerns include the following hazard: a) The expanded metal side contain which prevents the operator or other employee(s) from inserting their heads, limbs or body parts into the scissor point, created by the bucket arms and loader frame was removed and never replaced. Among other methods one feasible and acceptable method to abate this hazard is to ensure all guards are in place before permitting the loader to be operated reference 1926.602(a)(10).
