29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c). a) On or about April 23, 2025, at the Foxdale Ave. Water Main Project in Winnetka, Illinois, an employee was exposed to cave-in hazards while performing work in an unprotected excavation of approximately six feet in depth. The employer did not ensure the employee was protected from cave-in hazards. b) On or about April 24, 2025, at the Foxdale Ave. Water Main Project in Winnetka, Illinois, employees were exposed to cave-in hazards while performing work in an unprotected excavation of approximately seven feet six inches in depth. The employer did not ensure that employees were protected from cave-in hazards. c) On or about April 25, 2025, at the Foxdale Ave. Water Main Project in Winnetka, Illinois, an employee was exposed to cave-in hazards while performing work in an unprotected excavation of approximately six feet six inches in depth. The employer did not ensure the employee was protected from cave-in hazards. d) On or about April 25, 2025, at the Foxdale Ave. Water Main Project in Winnetka, Illinois, employees were exposed to cave-in hazards while performing work in an unprotected excavation of approximately six feet in depth. The employer did not ensure that employees were protected from cave-in hazards. e) On or about April 28, 2025, at the Foxdale Ave. Water Main Project in Winnetka, Illinois, employees were exposed to cave-in hazards while performing work in an unprotected excavation of approximately six feet six inches in depth. The employer did not ensure that employees were protected from cave-in hazards. f) On May 2, 2025, at the Foxdale Ave. Water Main Project in Winnetka, Illinois, an employee was exposed to cave-in hazards while performing work in an unprotected excavation of approximately eight feet six inches in depth in the south excavation for the setting of the manhole. The employer did not ensure the employee was protected from cave-in hazards. g) On or about May 2, 2025, at the Foxdale Ave. Water Main Project in Winnetka, Illinois, an employee was exposed to cave-in hazards while performing work in an unprotected excavation of approximately nine feet seven inches in depth in the east excavation for the setting of the fire hydrant. The employer did not ensure the employee was protected from cave-in hazards. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.
