29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): a) 4807 Long Beach Blvd., Beach Haven, NJ: Employee engaged in framing installation and other related activities was exposed to fall hazards, roughly 20 feet to the ground surface below, when walking on and working near unprotected edges of the second-floor level deck in the rear of a residential structure without the use of fall protection. Condition noted on or about 04/24/2025. b) 4807 Long Beach Blvd., Beach Haven, NJ: Employees engaged in framing installation and other related activities were exposed to fall hazards, roughly 20 feet to the ground surface below, when working near unprotected edges of the second-floor level window of a residential structure without the use of fall protection. Employee was sitting on a window frame and had one leg on the outside on the roof. Condition noted on or about 04/24/2025. AAR Riberio Construction LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1703180, citation number 1, item number 1 and was affirmed as a final order on 12/28/2023, with respect to a workplace located at 2600 Long Beach Blvd, Long Beach, NJ. AAR Riberio Construction LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1710658, citation number 1, item number 1 and was affirmed as a final order on 01/30/2024, with respect to a workplace located at 9212 Beach Avenue, Long Beach, NJ. AAR Riberio Construction LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1740194, citation number 1, item number 4 and was affirmed as a final order on 07/11/2024, with respect to a workplace located at 26 Anderson Drive, Long Beach, NJ. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
