29 CFR 1904.7(a): The employer did not record workplace injuries and illnesses that would be considered to meet the general recording criteria, and therefore to be recordable, if it results in any of the following: death, days away from work, restricted work or transfer to another job, medical treatment beyond first aid, or loss of consciousness. The employer must also consider a case to meet the general recording criteria if it involves a significant injury or illness diagnosed by a physician or other licensed health care professional, even if it does not result in death, days away from work, restricted work or job transfer, medical treatment beyond first aid, or loss of consciousness. The employer fails to maintain and provide OSHA with documents recording workplace injuries and illnesses forms (300 and 300A logs), including the years 2021-2025. The employer reportedly employs 10 to 12 employees. The employer is federally mandated to maintain these records. To abate this violation, the employer must keep injury and illness records and annual summaries as required by 29 CFR 1904.7. The employer must provide these records to OSHA when requested. Pursuant to 29 CFR 1903.19, the employer must submit documentation describing the steps it is taking to ensure compliance.
