OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees caused by unsafe racking systems: (a)156 West Harrisburg Ave, Elizabethtown, PA; Freezers 2 and 3 - On or about January 14, 2025, the blue horizontal cross members and green vertical posts on the storage racks visible from the entrance were damaged, were not marked for storage capacity, and were also not anchored, which exposed employees to struck-by hazards. (b) 156 West Harrisburg Ave, Elizabethtown, PA; Blending Area - On or about January 14, 2025, the 5-tiered/5-sectioned Polly Racking was not marked for storage capacity which exposed employees to struck-by hazards while working at or near the racking system. (c) 156 West Harrisburg Ave, Elizabethtown, PA; Hallway outside the Packaging/Production room - On or about January 14, 2025, the 3-tiered racking system did not have the load limit posted, was damaged on several vertical posts, and were not anchored to the floor which exposed employees to stuck-by hazards. Frozen Food Development and its successors was previously cited for a violation of the OSH ACT of 1970 Section (5)(a)(1), which was contained in OSHA inspection number 1709703, citation number 2, item number 1, and was affirmed as a final order on 05/13/2024, with respect to a workplace located at 156 West Harrisburg Avenue, Elizabethtown, PA 17022. Frozen Food Development and its successors was previously cited for a violation of the OSH ACT of 1970 Section (5)(a)(1), which was contained in OSHA inspection number 1558606, citation number 1, item number 2 and was affirmed as a final order on 6/01/2022, with respect to a workplace located at 156 West Harrisburg Avenue Elizabethtown, Pennsylvania. Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.
