29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, a personal fall arrest system, or an alternative fall protection measure as provided by another provision in paragraph (b) of this section: a. The employer does not maintain an effective program, including frequent and regular inspections by competent persons designated by the employer, to ensure that workers use fall protections in compliance with 29 CFR 1926.501(b)(13), as demonstrated on November 14, 2024, when employees installing roofing materials on the second-story 6:12 pitch roof of a residence located at 1008 North Central Avenue in Flagler Beach, Florida, were exposed to fall hazards ranging from 8 to 24-feet, in that the employees are not protected by, or utilizing any form of fall protection systems. Florida's Best Roofing, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1490709, Citation Number 1, Item Number 1, and was affirmed as a final order on February 24, 2021, with respect to a workplace located at 32 Wentworth Lane, Palm Coast, FL 32164.
