29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. a) On or about October 5, 2024, at 2797 Shaffer Avenue, Cincinnati, Ohio, the employer failed to ensure that Employee #5, performing re-roofing activities on a residential home, was protected from fall hazards while working at a height of approximately 14 feet above an asphalt driveway. The employer did not provide or enforce the use of guardrail systems, safety net systems, or personal fall arrest systems. As a result, employees were exposed to fall hazards during the course of their work. b) On or about October 5, 2024, at 2797 Shaffer Avenue, Cincinnati, Ohio, the employer failed to ensure that Employee #6, performing re-roofing activities on a residential home, was protected from fall hazards while working at a height of approximately 14 feet above an asphalt driveway.
