29 CFR 1915.73(d): When employees are exposed to unguarded edges of decks, platforms, flats, and similar flat surfaces, more than 5 feet above a solid surface, the edges shall be guarded by adequate guardrails meeting the requirements of 1915.71(j)(1) and (2), unless the nature of the work in progress or the physical conditions prohibit the use or installation of such guardrails. On or about September 5, 2024, at location 605 N Third Avenue, Sturgeon Bay, Wisconsin: employer did not ensure unguarded edges of decks, platforms, flats, and similar flat surfaces more than 5 feet above a solid surface were guarded by adequate guardrails. Fincantieri Marine Group, LLC DBA Bay Shipbuilding Co. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1915.73(d), which was contained in OSHA inspection number 1687671, citation number 1, item number 3/a and was affirmed as a final order on October, 19, 2023, with respect to a workplace located at 605 N Third Avenue, Sturgeon Bay, Wisconsin.
