29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system: a) On or about August 14, 2024, at the worksite, 103 Pitcher Lane, North Syracuse, NY 13212: when employees were replacing a 5:12 pitch roof, the employer failed to ensure the employees were protected from fall hazards by use of guardrail systems, safety net systems, or personal fall arrest systems. The employees were exposed to fall hazards of 9 feet. Segundo Caguana DBA 5 Star Construction 1 Corp. 5 Star Construction Corp. was previously cited for a violation of this occupational safety and health standard 1926.501(b)(13), which was contained in OSHA inspection number 1552410, citation number 1, item number 1, and was affirmed as a final order on November 7, 2021, with respect to a workplace located at 4554 Ashfield Terrace, Syracuse, NY 13215.
