29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels is not protected by guardrail systems, safety net system, or personal fall arrest system, nor are employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): (a) The employer is failing to protect each employee performing work 6 feet or more above the next lower level. The employer does not ensure that employees are protected from fall hazards while engaged in gutter and roof heat cable operations at heights greater than 6 feet, without the benefit of fall protection systems. On or about 7/8/2024, and at times prior, this practice led to the employer not protecting employees from exposure to fall hazards in excess of 6 feet while installing heat cable onto a customer's house located at 29108 Kinnikinnick LN, Evergreen, CO. An employee fell approximately 19.7 feet and died as a result of exposure to fall hazards while not utilizing fall protection. To abate this violation, the employer must come into compliance with this standard at all of its job sites to ensure employees engaged in residential construction activities above six feet are utilizing a fall protection system before roofing and gutter activities begin.
