29 CFR 1910.1200(g)(8): The employer did not maintain in the workplace copies of the required safety data sheets for each hazardous chemical, and did not ensure that they were readily accessible during each work shift to employees when they were in their work area(s) In the facility at 865 Quaker Highway Uxbridge, MA 01569: On or about May 17, 2024, at times prior, and at times after, safety data sheets were not maintained and available for all the chemicals. One of the hazardous chemicals found in the workplace and used daily by detailing and service technicians was Acrysol, (multiple 1 qt containers found in storage and in use) which contains a mix of Xylene (CAS-No: 1330-20-7), Ethyl benzene (CAS-No:100-41-4), Toluene (CAS-No: 108-88-3) and Solvent naphtha(petroleum), light aliphatic, (CAS-No: 64742-89-8). The SDS for Acrysol was not found in the binder. Camping World RV Sales, LLC was previously cited for a violation of this Occupational Safety and Health Standard 29 CFR 1910.1200(g)(8), which was contained in OSHA Inspection number 1583062, citation number 1 item number 2-a and was affirmed as a final order on August 3, 2022, with respect to a workplace located at 6440 Scully Drive Eau Claire, WI 54701 Although the Area Office held a conference with the employer prior to issuing this citation and the others now being issued in this inspection, the issuance of these citations does not represent the end of the inspection. The inspection is still open, due to the employer's failure to comply with the subpoenas that OSHA issued and served during the inspection. The Acting Secretary of Labor has filed a petition for subpoena enforcement in the U.S. District Court of Massachusetts, as part of which the Asking Secretary has asked that the statute of limitations for OSHA to issue citations be tolled.
