1910.30(a)(3) (3) The employer must train each employee in at least the following topics: 29 CFR 1910.28(b)(1)(i): Except as provided elsewhere in this section 29 CFR 1910.28, the employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling by one or more of the systems described in 29 CFR 1910.28(b)(1)(i): (a) On or about February 26, 2024, the employer, did not ensure that employees conducting gutter cleaning operations on a single-family residential home were protected from fall hazards in excess of four (4) feet in height. An employee fell from the roof which resulted in the employee sustaining a broken femur. The employer, Ned Stevens Gutter Cleaning & General Contracting of Illinois, LLC., was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1910.28(b)(1)(i), which was contained in OSHA inspection number 1481707, citation number 1 , item number 1, and was affirmed as a final order on April 8, 2021, with respect to a workplace located at 1245 Jefferson Ave, Naperville, IL 60540. The employer, Ned Stevens Gutter Cleaning & General Contracting of Illinois, LLC., was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1910.28(b)(1)(i), which was contained in OSHA inspection number 1438855, citation number 1, item number 1, and was affirmed as a final order on April 9, 2024, with respect to a workplace located at 2530 Palmer Court, Riverwoods, IL 60015.
