29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section: On or about February 6, 2024, on the southeast side of a trench; employees were working inside a trench without adequate cave-in protection while installing new water lines. CMD Endeavors Inc. was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 1686863, citation number 2, item number 1, and was affirmed as a final order on December 13, 2023, with respect to a workplace located at the Sean Haggerty Project Worksite, El Paso, TX 79934.
