29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge 6 feet or more above a lower level was not protected from falling by the use of a guardrail system, safety net system, or personal fall arrest system. a. The employer does not ensure employees on a walking/working surface with an unprotected side or edge 6 feet (1.8 m) or more above a lower level are protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. This violation was discovered on or about January 29, 2024; on the second-floor front roof: where employees were painting and caulking holes on the outside of the second-floor walls and were exposed to fall hazards. b. The employer does not ensure employees on a walking/working surface with an unprotected side or edge 6 feet (1.8 m) or more above a lower level are protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. This violation was discovered on or about January 29, 2024; on the platform above the second-floor stairway: where employees were painting, caulking and installing a wooden decorative design on the ceiling and were exposed to fall hazards. c. The employer does not ensure employees on a walking/working surface with an unprotected side or edge 6 feet (1.8 m) or more above a lower level are protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. This violation was discovered on or about January 29, 2024; on the second floor near the stairway: where employees working on the second floor were exposed to fall hazards. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the requirement, including describing the steps that it is taking to ensure employees on a on a walking/working surface with an unprotected side or edge 6 feet (1.8 m) or more above a lower level are protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.
