29 CFR 1926.652(a)(1):Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c). On or about December 5, 2023, at the excavation located at or near corner of Tamina Road and FM 2978, Magnolia, Texas, employees were in an excavation that did not have an adequate protection to protect them from a cave-in. The employer, Spring Creek Contracting, LLC, was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926. 652(a) , which was contained in OSHA inspection number 1521869, citation number 1, item number 2 and was affirmed as a final order on 7/22/21 with respect to a workplace located at 1641 Louetta Rd., SPRING, TX 77388.
