29 CFR 1915.77(c): When employees were working aloft, or elsewhere at elevations more than 5 feet above a solid surface, the employer did not provide either scaffolds or a sloping ladder, meeting the requirements of Subpart E-Scaffolds, Ladders, and Other Working Surfaces, to afford safe footing, and the employees were not protected by safety belts and lifelines meeting the requirements of 1915.159 and 1915.160: On or about November 11, 2023, inside the Mo-Gas Tank 4C 9-182-1 of the USNS 1st Lt Jack Lummus, each platform level (8 ft to 20 ft fall hazard) did not have a guardrail and employees were not protected by the use of a fall protection system.
