29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): a - 8 Penelope Lane, Middletown NJ: Workers engaged in the installation of shingles and other roofing materials were exposed to fall hazards, in excess of 12 feet 1 inch to the ground surface below, when walking on and working from a residential structure's pitched porch roof without the use of fall protection. Condition noted on or about 11/09/23. b - 8 Penelope Lane, Middletown NJ: Workers engaged in the installation of shingles and other roofing materials were exposed to fall hazards, in excess of 13 feet 1 inch to the ground surface below, when walking on and working from a residential structure's pitched garage roof while either improperly using fall protection or not using fall protection. Condition noted on or about 11/09/23 c - 8 Penelope Lane, Middletown NJ: Workers engaged in the installation of shingles and other roofing materials were exposed to fall hazards, in excess of 22 feet to the ground surface below, when walking on and working from a residential structure's pitched upper roof without the use of fall protection. Condition noted on or about 11/09/23 NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
