29 CFR 1926.501(b)(13):Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system: Location: roof of existing house On or about: 10/6/23 a) CBL Construction Corp. does not ensure that each employee uses fall protection while engaged in residential construction activities 6 feet (1.8 m) or more above lower levels. This violation was most recently observed, on or about October 6th, 2023, at 17 Jackson Rd., Briarcliff Manor, NY 10510, when employees framing a new addition to the residential building were not provided with any means of fall protection. The employees were exposed to a fall hazard of approximately 12 1/2 ft., to the ground below. Location: attic of house addition On or about: 10/6/23 b) CBL Construction Corp. does not ensure that each employee uses fall protection while engaged in residential construction activities 6 feet (1.8 m) or more above lower levels. This violation was most recently observed, on or about October 6th, 2023, at 17 Jackson Rd., Briarcliff Manor, NY 10510, when employees framing a new addition to the residential building were not provided with any means of fall protection. The employees were exposed to a fall hazard of approximately 8 feet 10 inches to the first floor and 12 1/2 ft., to the ground below. NOTE: Because abatement of this violation is already documented in the inspection casefile, the employer need not submit certification or documentation of abatement for this violation as normally required by 29 CFR 1903.19.
