29 CFR 1926.651(j)(2):Employees were not protected from excavated or other materials or equipment that could pose a hazard by falling or rolling into excavations. Protection by placing and keeping such materials or equipment at least 2 feet from the edge of excavations, or by the use of retaining devices that are sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary was not provided: Corner of Davis Ranch Parkway and Skanks Mill, San Antonio, TX, 78254: On or about September 13, 2023, and times prior thereto, employees were exposed to a struck-by hazard while inside an excavation with spoil piles located less than 2 feet from the edge of the excavation walls. The CTR Construction was previously cited for a violation of this occupational safety and health standard or its equivalent standard (1926.651(j)(2) which was contained in OSHA inspection number 1602125, citation number 1, item number 1, and was affirmed as a final order on 09-20-2022, with respect to a workplace located at 10500 Mitra Way & University Way, San Antonio, TX 78201.
