29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation. (a) On July 27, 2023, and at times prior, the employer does not require the use of eye protection while using pneumatic nail guns. This violation was most recently observed at 406 South 11th Street in Bismarck, North Dakota where employees were using pneumatic nail guns to fasten shingles to a residential roof without face and eye protection where nails and shingle particles could deflect into the eyes. To abate this violation, the employer must ensure that its employees performing roofing work are protected from hazards of potential eye injury. Note: This company was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard which was contained in OSHA Inspection Number 1630818, Citation 1, Item 1, and was affirmed as a final order on February 22, 2023, with respect to a workplace located at or near 5639 Niagara Drive in Bismarck, North Dakota.
