29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): a) 30 Wilson Avenue, New Square, NY: On or about 5/31/23, employees installing roof sheathing were exposed to a fall hazard of approximately 23 feet to 30 feet while working on the roof and were not protected against falling. b) 50 Wilson Avenue, New Square, NY: On or about 6/5/23, employees installing roof sheathing were exposed to a fall hazard of approximately 23 feet to 30 feet while working on the roof and were not protected against falling. c) 50 Wilson Avenue, New Square, NY: On or about 6/7/23, employees installing roof sheathing and installing trusses were exposed to fall hazards of approximately 23 feet while working on the roof and were not protected against falling. d) 50 Wilson Avenue, New Square, NY - Section furthest from Wilson Avenue) on 2nd Floor Stairwell Landing : On or about 5/31/23 to 6/5/23, employees walking/working inside the building were exposed to a fall hazard of approximately 12 feet 7 inches due to a wall opening on the 2nd floor landing to the ground below and were not protected against falling. e) 30 Wilson Avenue, New Square, NY: On or about 6/6/23, an employee was performing interior carpentry/framing work was exposed to a fall hazard of approximately 12 feet when he stepped over guard railing and worked on the outside exposed edge of the window opening and was not protected against falling. Because abatement of this violation is already documented in the inspection file, the employer need not submit certification or documentation of abatement for this violation as normally required by 29 CFR 1903.19. REPEAT STATEMENT: Dimension General Construction LLC was previously cited for a REPEAT violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1613923, citation number 1, item number 1 and was affirmed as a final order on 3/9/23, with respect to a workplace located at 46 Irvine Turner Boulevard, Newark, NJ 07102. Dimension General Construction LLC was previously cited for a WILLFUL violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1585939, citation number 2, item number 1 and was affirmed as a final order on 5/27/22, with respect to a workplace located at Melody Lane and Gold Finch Drive, Upper Saddle River, NJ 07458.
