29 CFR 1926.760(a)(1): Each employee engaged in a steel erection activity who is on a walking/working surface with an unprotected side or edge more than 15 feet (4.6 m) above a lower level was not protected from fall hazards by guardrail systems, safety net systems, personal fall arrest systems, positioning device systems, or fall restraint systems. Instance a) Elite Roofing Services, Inc. does not ensure that employees use fall protection while engaged in steel erection activities 15 feet or more above lower levels. This violation most recently occurred, between on or about April 11, 2023 and April 14, 2023, at 40 Garvies Point Rd, Glen Cove, NY 11542. Employee #4 was staging materials on the roof of the building as they were being unloaded by the delivery truck. Employee #4 walked and worked on the south-east/west edge of the building while being exposed to fall hazards without the use of a guardrail system, safety net system, personal fall arrest system, positioning device system, or fall restraint system. Instance b) Elite Roofing Services, Inc. does not ensure that employees use fall protection while engaged in steel erection activities 15 feet or more above lower levels. This violation most recently occurred, between on or about April 11, 2023 and April 14, 2023, at 40 Garvies Point Rd, Glen Cove, NY 11542. Employee #4 was installing corrugated steel decking and waterproof membrane on the roof of a commercial building. Throughout the workday the employee worked and walked near unprotected openings in the roof on the south-east side of the roof, approximately 18 feet above the ground, and was not protected from fall hazards by the use of a personal fall arrest system, safety net system, guardrail system, positioning device, or fall restraint system. Pursuant to 29 CFR 1903.19, within 30 days, the employer must submit documents describing the steps it is taking to ensure compliance, including a description of the type of fall protection provided and the steps taken to enforce use of appropriate fall protection where employees are exposed to possible danger of fall hazards.
