29 CFR 1904.29(b)(4): What is an equivalent form? An equivalent form is one that has the same information, is as readable and understandable, and is completed using the same instructions as the OSHA form it replaces. Many employers use an insurance form instead of the OSHA 301 Incident Report, or supplement an insurance form by adding any additional information required by OSHA. a) On March 2, 2023, an OSHA recordable incident occurred and was recorded on the Hartzell's Incident Report Form. The Hartzell Form was not equivalent to the OSHA 301 Incident Report Form in that it had not contained instructions for: 1. who completed the form; 2. the address of the injured employee; 3. the date of birth of the injured employee; 4. gender of the employee; 5. information about the health care professional; 6. treatment given away from the worksite; 7. if treatment occurred in an emergency room; 8. if the employee was hospitalized as an inpatient overnight; 9. the case number on the OSHA 300 Log; 10. what the employee was doing before the incident; 11. what was the injury or illness; 12. what object or substance directly harmed the employee; 13. and if the employee died, when the death occurred.
