29 CFR 1910.1200(g)(5): Upon becoming newly aware of significant information regarding the hazards of a chemical, or ways to protect against the hazards, the chemical manufacturer, the importer or employer did not add it to the safety data sheet within three months: (a) Warehouse - On or about January 11, 2023, the employer failed to provide the CARUS LLC CAIROX� Potassium Permanganate safety data sheet (SDS) with up-to-date handling and storage information thereby exposing employees to reactivity and fire hazards. Issued on November 27, 2013 and last revised on November 22, 2021, this SDS references NFPA 430: Code for the Storage of Liquid and Solid Oxidizers (2004) which was withdrawn in 2009 and incorporated into NFPA 400: Hazardous Materials Code (2010). NFPA 400 has since been updated and re-released in 2013, 2016, 2019, and 2022. Issued on October 19, 2021, this SDS references NFPA 430: Code for the Storage of Liquid and Solid Oxidizers (2004) which was withdrawn in 2009 and incorporated into NFPA 400: Hazardous Materials Code (2010). NFPA 400 has since has since been updated and re-released in 2013, 2016, 2019, and 2022. Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).
