29 CFR 1926.651(k)(1): An inspection of the excavations, the adjacent areas, and protective systems was not conducted by the competent person prior to the start of work and as needed throughout the shift: On or about December 22, 2022, the employer failed to ensure that there was a competent person performing inspection of the trench and associated hazards all throughout the work process to ensure employee are protected from hazards such as but not limited to cave in. The employer was digging a trench from the road to the home for a residential waterline install located at: 3427 Wyoga Lake Rd., Stow, OH 44224. NOTE: The employer was previously cited for a violation of this occupational safety and health standard or it's equivalent standard which was contained in OSHA Inspection #1364503, citation 1, item 1a, which was affirmed as final order on January 16, 2019, with respect to a job site located at 23250 Bryden Rd., Beachwood OH 44122.
