29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501(b): (a) The employer allows employees to work on residential roofs exceeding 6 feet in height without the use of fall protection. This was observed on or about November 8, 2022, when employees were working on a residential roof with heights ranging from approximately eleven (11) to twenty-eight (28) feet above ground level at 720 Marion Street, Scranton, PA. The employees so observed were not protected by either a guardrail systems, safety net system, or personal fall arrest system. Abatement: With respect to all future worksites in Pennsylvania, the employer must cease and desist from permitting employees to work on walking/working surfaces with unprotected sides or edges 6 feet or more above a lower level, unless each employee is protected by a guardrail system, safety net system, or personal fall arrest system, or unless the employer can establish that the exception set forth in 29 CFR 1926.501(b)(13) applies, in which case protection must be provided in accordance with 29 CFR 1926.502(k). Abatement certification and documentation to address the specific violation observed on or about November 8, 2022 is also required.
