29 CFR 1926.502(d)(17): The attachment point of the body harness was not located in the center of the wearer's back near shoulder level, or above the wearer's head: (a) The employer allows employees working on residential roofs exceeding 6 feet in height to use climbing harnesses rather than a personal fall arrest system that includes a body harness with an attachment point located in the center of the wearer's back near shoulder level, or above the wearer's head. This was observed on or about September 15, 2022, when employees were working on a residential roof approximately 20 feet above ground level at 726 Prescot Avenue, Scranton, PA. The employees so observed were not wearing body harnesses with an attachment point located in the center of the wearer's back near shoulder level, or above the wearer's head. Abatement: With respect to all future worksites in Pennsylvania, the employer must cease and desist from permitting employees to work on walking/working surfaces with unprotected sides or edges 6 feet or more above a lower level, unless each employee is protected by a personal fall arrest system that includes a body harness with an attachment point located in the center of the wearer's back near shoulder level, or above the wearer's head. This does not preclude the employer from providing fall protection other than personal fall arrest systems, so long as the chosen method of protection complies with the requirements of 29 C.F.R. Part 1926, Subpart M. Abatement certification and documentation to address the specific violation observed on or about September 15, 2022 is also required. The Date By Which Violation Must Be Abated listed below is for the specific violation observed on or about September 15, 2022. The cease and desist provision listed above is an ongoing obligation.
