29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section: (a) Lot 4 Emerald Way Mount Joy PA, New Residential Construction - An employee was on the front porch roof 10 feet 9 inches above grade with a 2 in 12 pitch installing framing on the main roof eves without fall protection, on or about June 8, 2022. (b) Lot 4 Emerald Way Mount Joy PA ,New Residential Construction - An employee was on the side of the main roof roof 10 feet 9 inches above grade with a 14 in 12 pitch installing sheathing and ice guard on the main roof without fall protection, on or about June 8, 2022. (c) Lot 4 Emerald Way Mount Joy PA, New Residential Construction - An employee was standing at the open window above the front porch 10 feet 9 inches above grade with a 2 in 12 pitch assisting with framing on the porch roof eave without fall protection, on or about June 8, 2022. Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.
