29 CFR 1926.501(b)(11): "Steep roofs." Each employee on a steep roof with unprotected sides and edges 6 feet (1.8 m) or more above lower levels shall be protected from falling by guardrail systems with toeboards, safety net systems, or personal fall arrest systems. Hector Hernandez dba Town City Construction does not require the use of fall protection when employees are exposed to fall hazard. This was most recently observed on May 16, 2022, at a commercial worksite located at N1673 Municipal Road, Greenville Wisconsin, when six employees and the supervisor were exposed to a fall hazards of approximately nine feet and a roof pitch of 4.5:12 and greater while removing old shingles and installing new shingles on a commercial building having a steep pitch roof without fall protection.
