Text For Citation: 02 Item/Group: 001 Hazard:

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest system. On 5/10/2022, employees from Fregalette Construction, LLC were constructing interior walls on the second story of a residential building located at 400 Amberleigh Manor Drive in Wentzville, MO. The foreman was observed accessing the first-story roof through a second-story window opening to retrieve building material 10 feet above the ground without utilizing guardrail systems, safety net system, or personal fall arrest system. Fregalette Construction, LLC was previously cited for a violation of this occupational safety and health standard 29 CFR 1926. 501(b)(13), which was contained in OSHA inspection number 1270933, citation number 1, item number 3, issued on 10/24/2017, and was affirmed as a final order on 11/9/2017, with respect to a workplace located at a residential building located on lot 329 Luxembourg Gardens Court in Wentzville, MO.
