29 CFR 1926.501(b)(13):"Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. The employer continues to fail ensure employees are protected from falls while they installed asphalt shingles to the roof top of a new build residential home. The most recent incident of such failure occurred on or about May 5, 2022, located at 361 Kells Court West, Lot 13557, Newark, Ohio 43055: the employer failed to ensure that an employee was protected from falls while conducting work on the roof of a new build residential home. The employee was exposed to a fall distance of 20 feet to the ground level. Mr. �ngel P�rez, was previously cited for a Willful violation for this occupational safety and health standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1568670, citation number 2, item number 1 and was affirmed as final order on April 28, 2022, with respect to a workplace located at Lot 231 Granville, OH 43023 Mr. �ngel P�rez, was previously cited for a repeat violation for this occupational safety and health standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1501959, citation number 1, item number 2 and was affirmed as final order on April 12, 2021, with respect to a workplace located at 174 Preserve Drive Lot 9 Pickerington, OH 43147 Mr. �ngel P�rez, was previously cited for a repeat violation for this occupational safety and health standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1460891, citation number 2, item number 3 and was affirmed as final order on April 09, 2020, with respect to a workplace locate at 6922 Duke Drive, Canal Winchester, OH, 43110. Mr. �ngel P�rez, was previously cited for a serious violation for this occupational safety and health standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1335305, citation number 1, item number 3 and was affirmed as final order on October 24, 2018, with respect to a workplace locate at 6045 Kenzie Lane (Lot #44), Dublin, OH, 43017. Pursuant to 29 C.F.R 1903.19, the employer must submit documents describing the steps it is taking to ensure compliance, including a description of how these steps protect its employees from the fall hazards.
