29 CFR 1926.501(b)(11):Each employee on a steep roof with unprotected sides and edges 6 feet or more above lower levels was not protected from falling by guardrail systems with toeboards, safety net systems, or personal fall arrest systems: a) On February 1, 2022, at the above addressed jobsite, employees conducting installation of a roof on an occupied commercial property, at approximately 12 feet above the ground, were not provided personal fall arrest systems or other means of fall protection, thereby exposing the employee to fall hazards. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records. EV Construction and Roofing was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1, citation number 1, item number 1 and was affirmed as a final order on October 30, 2018, with respect to a workplace located at S88 W12931 Ballard Court in Muskego, Wisconsin.
