29 CFR 1926.651(k)(1): An inspection of the excavations, the adjacent areas, and protective systems was not conducted by the competent person prior to the start of work and as needed throughout the shift: On or about October 23, 2021, and at times prior thereto, employees were installing wastewater utility pipe in the bottom of an excavation up to approximately 13 feet deep without a competent person performing an inspection, exposing employees to the hazard of being struck-by materials and equipment.
