29 CFR 1910.28(b)(6)(ii): Each employee 4 feet (1.2 m) or more above dangerous equipment was not protected from falling: Central Paper Stock, Inc. located at 6665 Jonas Place in Berkeley, MO 63134: The employer is failing to protect employees from fall hazards while they clear jams over a large "Harris Selco" paper baler (Model: HLO-8221AR-150; Serial No: 39770079). This condition most recently occurred: (a) On 10/26/2021 when an employee attempted to clear a paper jam while standing directly adjacent to and/or over the paper baler chute. As the employee cleared the jam, he fell approximately 17-feet in the baler chute where he was crushed by the baler's hydraulic press; and (b) On or around 10/24/2021 when an employee cleared a paper jam while standing directly adjacent to and/or over the paper baler chute. Amended to: The classification of Citation 2, Item I as herein amended shall remain willful as issued. The AVD is amended to include as follows: Central Paper Stock, Inc. located at 6665 Jonas Place in Berkeley, MO 63134: 1. The employer is failing to protect employees from fall hazards while they clear jams over a large "Harris Selco" paper baler (Model: HLO- 8221 AR-150; Serial No: 39770079). This condition most recently occurred: (a) On 10/26/2021 when an employee attempted to clear a paper jam while standing directly adjacent to and/or over the paper baler chute. As the employee cleared the jam, he fell approximately 17-feet in the baler chute where he was crushed by the baler's hydraulic press; and (b) On or around 10/24/2021 when an employee cleared a paper jam while standing directly adjacent to and/or over the paper baler chute. 2. The employer is failing to protect employees from elevated fall hazards. This condition was most recently observed on or about 10/26/2021. The employee ascended approximately seventeen-feet vertically over the horizontal length of 38.75 feet at a thirty-degree angle on the conveyor belt which has product guards on either side that measure approximately thirty-six inches in height. The employer did not ensure each employee on a walking-working surface with an unprotected side or edge that is four feet (1.2 m) or more above a lower level was protected from falling by a guardrail system, safety net system, travel restraint system, or personal fall arrest system
