29 CFR 1926.501(b)(13):Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): a) The employer fails to ensure effective protection against falls as required by the standard, as demonstrated on or about October 18, 2021, at a new home construction site located at 5416 Spanish Moss CV, Bradenton, FL, 34203, when employees were performing framing work on a roof, without fall protection, are exposed to a fall hazard of 25 feet 3 and 3/16th inches to ground level. To abate this violation, the employer must ensure that all employees are provided with and utilize fall protection or install a guardrail or safety net system when an employee works 6 feet or more above lower levels. Pursuant to 29 CFR 1903.19, the employer must submit documents describing the measures it is taking to ensure compliance, including an explanation of how these steps protect its employees from fall hazards.
