29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation: a. The employer fails to ensure eye protection is used as demonstrated on or about 10/16/2021, at Lot #4 James Taylor Road, Moody, Alabama, where two roofers were observed operating nail guns without wearing eye protection. To abate this hazard, the employer must ensure eye protection is worn. Pursuant to 29 CFR 1903.19, the employer must submit documents describing the measures it is taking to ensure compliance, including an explanation of how these steps ensure that eye protection is used when employees are exposed to eye hazards from flying particles. Vicente Olmas Gayosso dba Vicente Olmas Gayosso was previously cited for a second repeat violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.102(a)(1), which was contained in OSHA inspection number 1542443, citation number 1, item number 1 and was affirmed as a final order on 09/21/2021, with respect to a workplace located at 345 Taylors Way, Moody, AL.
