29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b). Martine Contractors LLC does not ensure that employees use appropriate fall protection while engaged in residential construction activities 6 feet (1.8 m) or more above lower levels. This violation was most recently observed, on or about, 9/7/21, at 741 2nd Ave., Lyndhurst, NJ, at instance (a): Exterior of Building - Roof: Employees without any means of fall protection were exposed to fall hazards varying from approximately 16 feet to 25 feet while engaged in roofing activities without any method of fall protection. To abate this violation the employer must ensure that its employees performing roofing work are protected from falls and that no employee is allowed to be exposed to a fall hazard of 6 feet or more without adequate fall protection. One employee fell and was transported to the hospital being pronounced dead a few days later.
