29 CFR 1926.651(k)(2): Where the competent person finds evidence of a situation that could result in a possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employees were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety. a.) 30 Williams Street, Northampton, MA: On or about August 3 , 2021 and at times prior, the competent person was aware of conditions that could result in possible cave-ins while working in an unprotected excavation measuring approximately 5'5" to 13' feet high x 70' long x 9' to 10' wide and employees were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety.
