29 CFR 1910.146(c)(6): When there were changes in the use or configuration of a non-permit confined space that could increase the hazards to entrants, the employer did not reevaluate that space and, when necessary, reclassify it as a permit-required confined space: On or about May 13, 2021, and at times prior, at the Kerr Dam, employees entered into the inspection gallery to perform work and were exposed to hazardous conditions. Pursuant to 29 CFR 1903.19, within thirty (30) calendar days of the date of this citation, the employer must submit documentation describing the steps taken to ensure the employer reevaluates the space and, when necessary, reclassify it as a permit-required confined space to protect employees from permit-required confined space hazards.
