29 CFR 1926.503(a)(1):The employer shall provide a training program for each employee who might be exposed to fall hazards. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards. The employer does not provide a training program for each employee exposed to an approximately 26 foot (3 story) fall hazard while performing residential construction framing activities. The employees were not trained to recognize the hazards of falling and/or the procedures to be followed to minimize fall hazards. This most recently occurred on January 21, 2021, at a construction site located at Building 15, Concord Village, Chenin Run, Avon, Ohio. Employees were exposed to fall hazards of approximately 26 feet (3 stories) from the roof to the ground while installing a wood framed firewall structure during the construction of a residential townhouse, without being provided with a fall hazard training program and/or being trained to recognize the hazards of falling and the procedures to be followed to minimize fall hazards. To abate this hazard in the future, the employer must ensure employees are provided with a training program and trained to recognize fall hazards and the procedures to minimize fall hazards. Pursuant to 29 CFR 1903.19, the employer must submit documents describing the steps it is taking to ensure compliance, including an explanation of how these steps protect its employees from fall hazards. STOLZFUS CONSTRUCTION, LLC., WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD, 29 CFR 1926.503(a)(1), WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 1467576, CITATION NUMBER 02, ITEM NUMBER 01b, AND WAS AFFIRMED AS A FINAL ORDER ON JUNE 08, 2020, WITH RESPECT TO A WORK PLACE LOCATED AT 3051 BLUEBIRD COURT, AVON, OHIO. STOLZFUS CONSTRUCTION, LLC., WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD, 29 CFR 1926.503(a)(1), WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 1407351, CITATION NUMBER 01, ITEM NUMBER 01b, AND WAS AFFIRMED AS A FINAL ORDER ON AUGUST 08, 2019, WITH RESPECT TO A WORK PLACE LOCATED AT 297 FAIRVIEW PARK DRIVE, AVON, OHIO.
